Ocean Tarkari is a direct-to-consumer vegetable retail business operating through oceantarkari.com and oceantarkari.com.np. We source fresh vegetables from local dealers and sell them directly to you. We are the seller of record for every item listed on our platform. We are not a marketplace.
Company Details
These Terms comply with Nepal's E-Commerce Act, 2081 (2025) and the Consumer Protection Act, 2075. Where any conflict exists between these Terms and applicable Nepalese law, the law prevails.
To place an order you must register an account and provide accurate, current information. You are responsible for:
You must be at least 18 years of age to register. Minors may use the platform only under direct parental or guardian supervision.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.
All products listed are fresh vegetables and perishable agricultural produce. We make reasonable efforts to ensure:
Weight disclosure: Listed weights are net weights before packaging. Minor variations of up to ±5% may occur due to natural produce characteristics. You will not be charged for any shortfall beyond this tolerance.
If a pricing error occurs, we will contact you before processing your order. We reserve the right to cancel orders placed at clearly incorrect prices.
Contract formation: Your order is an offer to purchase. A binding contract is formed only when we send you a confirmed order notification by email or SMS.
Accepted payment methods:
Prepaid orders must be paid in full before goods are dispatched. We do not store payment card details on our servers. All digital payments are processed by NRB-licensed third-party payment gateways.
Order modification: You may modify or cancel an order within 1 hour of placement, provided preparation has not commenced. Contact us at support@oceantarkari.com immediately.
Service areas: We deliver within designated zones shown at checkout. Delivery outside listed areas is not available.
Timelines: We aim to deliver within the slot you choose at checkout. Estimates are not guaranteed and may vary due to weather, traffic, or events beyond our control.
Delivery charges: Any applicable fee is displayed at checkout before confirmation. Free delivery thresholds, where offered, are shown on the product page.
Risk transfer: Risk of loss passes to you upon delivery at your specified address. If you are absent, we may leave goods with another person at the premises or reschedule. We are not liable for spoilage caused by delayed collection after a successful delivery attempt.
Failed deliveries: If delivery fails due to an incorrect address or inaccessible location provided by you, re-delivery charges may apply.
⚠ No Standard Returns — Perishable Goods
Fresh vegetables are perishable goods. Standard returns are not accepted. This is consistent with the perishable goods exception under Section 14, Consumer Protection Act, 2075. Food safety and hygiene standards do not allow us to accept returned produce.
Refunds or replacements are accepted only in the following three situations:
Wrong item delivered
You received a product different from what you ordered.
Spoiled or damaged on arrival
Vegetables arrived visibly rotten or damaged due to our handling or packaging.
Non-delivery
Your order was marked as delivered but you did not receive it.
How to raise a request:
Order cancellation:
Orders may be cancelled within 1 hour of placement if preparation has not started. Once preparation has begun, cancellation is not possible. For COD orders, cancellation at the door once the delivery agent has arrived is not accepted.
By using our platform, you agree not to:
Violations may result in immediate account suspension and, where warranted, referral to Nepalese law enforcement authorities.
Our platform is provided on an "as is" basis. We make no warranties, express or implied, regarding:
Liability cap: To the maximum extent permitted under Nepalese law, our total liability for any claim arising from a transaction is limited to the amount you paid for that specific order. We are not liable for indirect, incidental, or consequential losses.
Nothing in these Terms limits your statutory rights as a consumer under Nepal's Consumer Protection Act, 2075.

Complaint procedure:
These Terms are governed by and construed in accordance with the laws of the Federal Democratic Republic of Nepal.
Any dispute not resolved through our grievance mechanism is subject to the exclusive jurisdiction of the competent courts of Nepal, with venue in Kathmandu.
Both parties agree to attempt good-faith resolution before initiating formal legal proceedings.
We may update these Terms at any time. Material changes will be communicated by a notice on the website homepage and by email to registered account holders. Continued use of the platform after the effective date of any change constitutes acceptance of the updated Terms.
We are required under the E-Commerce Act, 2081 to retain transaction records for a period of 6 years.
